Rep. Andy Harris threatened a student journalist with prosecution for recording a post-debate press gaggle.
What Happened in Cambridge
After a contentious debate with Democratic challenger Dan Schwartz in Cambridge, Maryland, on October 13, 2026, Rep.
Andy Harris singled out Capital News Service reporter Cat Murphy during a press gaggle, telling her: "You do not have my permission to record. If you record, we will refer you to prosecutors."
Murphy, a data reporter and master's student at the University of Maryland, replied that "everyone in here is recording" — the video shows at least eight journalists participating.
Harris repeatedly invoked Maryland's two-party consent law and, when Murphy pressed him about U.S. military hostilities with Iran, called for an officer to "take her camera" before pushing out of the room. (ABC News; WBAL-TV; Hindustan Times)
Why the Legal Threat Falls Apart
Harris cited the Maryland Wiretapping and Electronic Surveillance Act, which makes it a felony punishable by up to five years in prison and a $10,000 fine to willfully intercept communications without all-party consent.
But as ABC News reports, the law protects only private conversations — not a public official answering questions from accredited journalists, where participants have no reasonable expectation of privacy.
Attorney Steve Silverman told WBAL-TV 11 News that Maryland's two-party consent law applies to private conversations. Murphy, who is credentialed through a U.S. Capitol gallery, stood her ground: "With all due respect, this is a public forum," another reporter added.

The Exchange, Caught on Camera
The entire quarrel was captured on video by a Baltimore Banner photojournalist, which is how it spread nationally.
In the footage published by ABC News and detailed by WBAL-TV, Harris insists "audio and video have to have two-party approval in Maryland" and declares "I'm disinviting you. You are gone."
Murphy answers that he "invited the press" and notes his public appearances have been limited to funding announcements. Harris then asks, "Can you escort her out?" and laments, "She's ruining all your chances to get an answer about anything."
The recording itself demonstrates the transparency Harris was trying to block. (ABC News; WBAL-TV)
Harris Doubles Down on Wednesday
The congressman did not back down. Harris told WBAL NewsRadio that the gaggle was held in a private room with an expectation of privacy: "This was not a public forum. We were in a private room, but media were invited in at our invitation."
He also said Murphy was expressing opinions rather than asking questions. His campaign separately claimed agitators were "bussed in from as far away as New Jersey" and that one person faces charges after assaulting a Harris supporter.
ABC News reports it sought comment from Harris on Wednesday but received no response. (WBAL-TV; ABC News)
University of Maryland Backs Its Student
The dean of the University of Maryland's Merrill School of Journalism issued a statement defending Murphy: "Cat recorded openly in a public space alongside other news outlets, and that is her legal right. I'm proud of how she handled herself in a difficult situation."
Murphy herself told WBAL-TV 11 News she was just doing her job. The university's swift support matters because the target was a student journalist — exactly the kind of reporter a powerful incumbent might expect to back down.

The Stakes for Press Access
Press-freedom commentators argue that threatening journalists with criminal charges creates a chilling effect, especially on small outlets and student reporters who cannot absorb legal risk — and that the publicity around the clash has amplified the story far beyond the original questions about Iran Harris was trying to avoid.
With the video widely circulated and national outlets covering it, the incident now sits at the center of his reelection race. (Hindustan Times; ABC News; Geosirius)
