The man ICE identified as its target in a Houston operation that left a worker hospitalized had died in 2017, his family and advocates say.

What Happened in Houston

On October 10, an ICE agent driving an SUV struck Miguel Parra Hernández, 48, a construction worker, in northwest Houston, leaving him with hip, leg and ankle injuries including a broken leg.

ICE said agents were conducting a targeted enforcement operation to arrest Jose Mendoza-Cervantes, claiming Parra Hernández ran in front of the vehicle.

Surveillance video showed the SUV crossing a median in pursuit of the fleeing man, and Harris County District Attorney Sean Teare said it is 'pretty obvious' from videos that ICE intentionally struck him, per NBC News.

The officer driving has been placed on administrative leave, and Parra remains hospitalized in ICE custody needing more surgeries.

The Twist: A Target Who Died in 2017

After the crash, ICE issued a statement with a headshot of the man it identified as Mendoza-Cervantes, stamped 'wanted.'

But the daughter of the pictured man told an immigrant civil rights group and The New York Times that the photo was of her father, José Hector Jimenez Mendoza, who died in 2017 while trying to enter the United States.

Jamie Jimenez said her father used several aliases, including the name ICE referenced, and family representatives provided a Mexican death certificate listing his death year as 2017 and location as Laredo, Texas.

'Either someone is not telling the truth or, all of a sudden, the two ICE agents have developed a sixth sense and are able to see dead people,' said FIEL Houston's Cesar Espinosa at a Friday press conference.

Why the Case Is So Startling

The revelation compounds an already serious use-of-force dispute with a factual error that defies explanation: ICE publicly circulated a photograph of a man who had been dead for nearly a decade as its at-large target.

Parra Hernández's family says he did not even know Mendoza-Cervantes, and Jezebel reports that friends and relatives say he requires multiple surgeries to recover.

Espinosa introduced the other man who fled with Parra, identified only as 'Omar,' who confirmed he was in the car but would not take questions.

The mistaken identity raises the possibility that ICE either confused its target with a dead man or was not pursuing anyone specific at all, and ICE and DHS have not responded to questions about Jimenez Mendoza.

Criminal Charges Considered

Harris County DA Sean Teare is investigating ICE on a possible aggravated assault with a deadly weapon charge, and NBC News reports he could take the case to a grand jury as soon as next week.

Teare also accused federal agents of compromising the crash scene by leaving with the SUV, according to OK Magazine.

FIEL has turned over relevant documents to Teare's office and called on ICE to release all body-camera footage; a senior DHS official said a decision on releasing video had not been made. ICE has called allegations that it intentionally struck Parra 'RECKLESS and FALSE.'

Detainees and What Comes Next

The incident also swept up others: attorney Kim Bruno is representing Luis Delfín Martínez, one of two men handcuffed and unbuckled in the back of the ICE vehicle during the pursuit, who Jezebel and NBC report suffered soft-tissue injuries and is detained at the Montgomery Processing Center in Conroe, Texas.

Teare said his office interviewed the second detainee, José Presa Cañada, at a south Texas detention center and obtained 'a significant amount of relevant details from him,' and that ICE planned to deport Presa.

With a possible grand jury looming and FIEL demanding the truth, the case now hinges on bodycam footage and whether prosecutors file charges against the agent on leave.
