Selma Blair pleaded not guilty to second-degree assault charges after an alleged midair attack on Delta crew, with bail set at $20,000.
What Happened Aboard Delta Flight 938
Actress Selma Blair, 54, was arrested Sunday night after flight attendants reported a "physically abusive passenger" aboard Delta Air Lines Flight 938, which had arrived at New York's JFK Airport from Los Angeles.
According to multiple outlets including TMZ, ABC News and Reuters, Blair allegedly punched one flight attendant and bit another mid-flight; one crew member sustained a laceration and the other a bite, and one was taken to a hospital.
Yahoo, citing TMZ, reports she also attempted to open an aircraft door in mid-flight.
The crew restrained her on the plane, and pilots radioed ahead requesting medical personnel at the gate, noting injuries including a bloody nose, bite marks, and a head the pilot said the disruptive passenger appeared to have bashed against a bulkhead.
From the Gate to the Courtroom
The cascade continued after landing. Port Authority police took Blair into custody at JFK and she was transported to Jamaica Hospital for evaluation, according to ABC News and CBS New York.
The criminal complaint alleges Blair repeatedly kicked Port Authority Officer Maria Suarez in the face, neck and chest during transport to the ambulance, and later kicked registered nurse Ashley DeLeo in the chest at the hospital, per ABC News. The nurse pressed charges.
Monday night, Blair was arraigned in Queens Criminal Court on two counts of second-degree assault under New York Penal Law 120.05(3), entered a not guilty plea, and was released on bond after a judge set bail at $20,000 cash, $60,000 bond, or a $60,000 partially secured bond, as ABC News, Page Six and CBS New York all report.
Why This Flight Went Wrong
Her representatives and attorneys frame the episode as medical, not criminal. Blair's rep said in a statement carried by multiple outlets that "Selma experienced a medical emergency that led to the alleged conduct" and that she received immediate medical attention and is in stable condition.
Page Six reports that defense attorney Shawn Barnes told the court Blair had missed multiple doses of her multiple sclerosis medication, had fallen and hit her head, and had worked "extensive and exhaustive hours" before boarding — factors Barnes said, combined with altitude, produced "severe confusion and disorientation."
A Chilling Echo of 2016
The incident is a near-decade repeat.
In June 2016, Blair was carried off a Delta flight from Cancun to Los Angeles on a stretcher after an outburst in which witnesses said she made alarming statements; she later apologized, saying she mixed alcohol with medication and blacked out, according to ABC News.
This time, no alcohol mixing is alleged, but the pattern — a midair medical or psychiatric emergency escalating to violence — is what makes the story resonate with travelers.
CBS New York adds that Blair has spoken openly about the difficulties of traveling with MS, and notes her service dog, which was traveling with her, is now in the custody of her attorney.
What's at Stake — for Blair and Airlines
The legal exposure is significant: Page Six reports Blair faces two to seven years in prison if convicted on the state assault counts, and she also received a federal summons charging assault within the special maritime and territorial jurisdiction of the United States — the jurisdiction covering aircraft — per TMZ and ABC News.
The FBI and FAA are investigating, though ABC reports the federal summons carries no appearance date. Delta, which said the flight landed early with no operational impact, stated that it has "zero tolerance for unruly or unlawful behavior, as the safety of our customers and crew always comes first."
For airlines, the case underscores how midair medical emergencies can turn into crew-safety incidents requiring restraints.
What Comes Next
The state case now heads toward a January 19, 2027 court date, with Page Six reporting the judge granted an order of protection for the hospital nurse and admonished the defense that "Ms. Blair should not get special treatment because she is a celebrity."
The federal matter remains open-ended, with no appearance date set.
