Flynn Defense Rests With No Witnesses as Closing Near

Caleb Flynn's lawyers rested his murder trial without calling a single witness, leaving closing arguments and jury deliberations to begin Tuesday in Troy, Ohio.

After eight days of testimony from 40 prosecution witnesses, Caleb Flynn's defense rested on Monday without calling any witnesses, and Flynn himself did not testify, according to CTV News citing the Associated Press. Closing arguments are set for Tuesday, followed by the start of jury deliberations.

The decision to present no defense case is a striking gamble in a trial where prosecutors built a motive narrative around a secret 1.5-year affair and more than 100,000 exchanged text messages. Defense attorney Emily Smith acknowledged in opening statements that Flynn cheated and sent the messages, telling jurors, per ABC7 Chicago, that "a man can fail as a husband without being a murderer." The defense's core argument remains the absence of the murder weapon: the handgun Flynn said he kept in his truck console has never been found.

Prosecutors leaned on motive and on dismantling Flynn's intruder story. Jurors heard texts in which Flynn wrote, "I just want her dead and gone," and, on August 22, 2025, "I was up until 4 a.m. last night crying, literally thinking of ways to kill her and not go to jail." His former lover Alleigha Botner testified over two days, at times sobbing as she read her own messages. Phone records placed Flynn at the home at the time of the killing, and the garage side door showed no forced-entry damage, per ABC7 Chicago.

Investigators testified the scene did not match Flynn's account. The bunkbed in his daughters' room was too crowded with stuffed animals to hold an adult, an Ohio Bureau of Criminal Investigation agent said, per ABC7 Chicago. A police canine tracked a human scent from the garage door straight into the house with no prints leaving the property, and Ashley's father testified the family's goldendoodles always barked at strangers yet stayed silent that night. Prosecutors also played AI-generated love songs Flynn made for Botner, CTV News reports.

The case now moves to closing arguments Tuesday and then jury deliberations, with Flynn facing charges including murder, assault and tampering with evidence, according to CTV News. Prosecutors told jurors in opening statements that recovering the gun was not necessary for a conviction, and legal analyst Joey Jackson told ABC7 Chicago that the missing weapon has "very little" impact on the case given the other evidence. A verdict would cap a trial that has captivated the true-crime world with its mix of affair texts, deleted messages and lies to the FBI.
