A federal grand jury declined to indict former White House aide Cassidy Hutchinson over her Jan. 6 testimony.
Grand jury says no
A federal grand jury in Washington on Tuesday declined to return an indictment against Cassidy Hutchinson, the former White House aide who gave dramatic 2022 testimony about President Trump's conduct during the Jan.
6, 2021, Capitol attack, according to two people familiar with the matter speaking to the Associated Press. The Washington Post first reported the decision, and a senior U.S. official confirmed the case to NBC News.
Prosecutors sought charges over statements she made about Trump's actions that day, but the jury returned a 'no bill,' rejecting the Justice Department's effort. Her name was not mentioned in the courtroom when the decision was announced.
A string of failed prosecutions
The rejection is the latest setback in the Justice Department's efforts to charge perceived adversaries of the Republican president. NBC News reports the department has investigated or charged figures including Sen.
Adam Schiff, former CIA Director John Brennan, New York Attorney General Letitia James and former FBI Director James Comey, and failed three times to indict James over an initial dismissal. The administration also tried and failed to indict six Democratic House members over a social media video.
The spike in denials led the chief federal judge in Washington to require the department to notify the magistrate judge on duty whenever a grand jury refuses an indictment.
The testimony at issue
Details of prosecutors' allegations against Hutchinson were not immediately clear, but Republican lawmakers had accused her of lying under oath about her explosive 2022 account before the House Jan. 6 committee.
As special assistant to chief of staff Mark Meadows, she described an angry president who wanted armed protesters allowed past security screenings, reportedly grabbed at his SUV's steering wheel when the Secret Service refused to drive him to the Capitol, and declined to intervene as the crowd chanted 'Hang Mike Pence.'
Trump denied much of her account on Truth Social, calling her a 'total phony.'
The disputed SUV story
Hutchinson's description of the altercation inside the presidential SUV was regarded as particularly explosive, even as she acknowledged she was relating what a White House security official told her rather than firsthand knowledge.
According to PBS, House Republicans released a transcript in March 2024 in which the Secret Service driver said he did not see the altercation and that Trump never grabbed the steering wheel, while corroborating other aspects of her account, including Trump's attempt to join the mob scene at the Capitol.
Secret Service officials denied the account; Hutchinson has maintained her testimony was truthful.
Pressure from Trump's circle
Hutchinson has alleged that members of Trump's inner circle dangled job opportunities and financial assistance while she cooperated with the committee, and testified that her own lawyer, a former Trump White House ethics counsel, told her 'the less you remember, the better.'
According to CBS News, House Republican allies of the president made the referral to the Justice Department, and the Civil Rights Division, headed by Trump appointee Harmeet Dhillon, handled the investigation. Trump has called Hutchinson a 'scam artist' and suggested she be prosecuted.
What comes next
The grand jury's refusal does not bar the Justice Department from trying to charge Hutchinson again, though its investigation centered on testimony to the now-defunct House Jan. 6 committee.
The decision also lands amid broader efforts to revisit Jan. 6: Trump pardoned the rioters on his first day back in office and reached a $1.8 billion 'anti-weaponization fund' agreement with the Justice Department, which NBC News reports was later scuttled.
Hutchinson's lawyers and the Justice Department did not immediately respond to requests for comment, leaving open how — or whether — prosecutors will regroup.
